This Privacy Policy explains how DVNT, s.r.o. processes the personal data of customers, visitors to our online store and other individuals who communicate with us.

The processing of personal data is governed in particular by Regulation (EU) 2016/679 of the European Parliament and of the Council, the General Data Protection Regulation (“GDPR”), as well as other applicable legislation.

DVNT, s.r.o. determines which personal data is processed, for what purposes and for how long it is retained. We have not appointed a Data Protection Officer. For any matters relating to the protection of personal data, you may contact us using the details provided above.

WHAT PERSONAL DATA WE PROCESS AND WHY

ENQUIRIES AND CONTACT FORMS

If you contact us via a contact form, e-mail, telephone or social media, we may process in particular:

  • your first and last name,

  • e-mail address and telephone number,

  • the content of your message,

  • any other information you voluntarily provide to us as part of your communication.

We use this information to respond to your enquiry, provide advice, prepare an offer or discuss a potential order.

The legal basis for processing is taking steps at your request prior to entering into a contract pursuant to Article 6(1)(b) GDPR. In the case of general enquiries, processing may also be based on our legitimate interest in communicating with customers pursuant to Article 6(1)(f) GDPR.

If the communication does not result in an order, we generally retain it for no longer than one year after the communication has ended, unless a longer retention period is necessary to protect our rights.

ORDERS AND PERFORMANCE OF THE CONTRACT

If you make a purchase from us, we process in particular:

  • your first and last name,

  • billing and delivery address,

  • e-mail address and telephone number,

  • details of the products ordered,

  • payment information and payment status,

  • information required for delivery,

  • order history and related communications.

We do not receive or store your complete payment card details. Payments are processed through an external payment gateway.

We process personal data for the purposes of:

  • receiving and processing your order,

  • receiving payment,

  • producing or altering the ordered product,

  • delivering your order,

  • communicating with you regarding its progress,

  • handling returns, exchanges and complaints,

  • complying with accounting, tax and other legal obligations,

  • protecting our rights in the event of a dispute.

The legal basis for processing is the performance of a contract pursuant to Article 6(1)(b) GDPR, compliance with legal obligations pursuant to Article 6(1)(c) GDPR and, where appropriate, our legitimate interest in protecting and enforcing legal claims pursuant to Article 6(1)(f) GDPR.

We retain data required to process an order for the duration of the contractual relationship and generally for a further three years, unless longer retention is necessary due to a complaint, dispute or legal obligation.

Accounting and tax records are retained for the periods required by applicable legislation, generally for five or ten years depending on the type of document.

MADE-TO-MEASURE AND PERSONALISED PRODUCTS

If you order a made-to-measure or personalised product, we may also process:

  • measurements and sizing information provided by you,

  • your requested wording, initials, date or monogram,

  • information regarding requested alterations to the product,

  • related communications and, where applicable, photographs that you voluntarily provide to us.

We use this information solely for the production and delivery of the ordered product, handling any subsequent alterations or complaints, and protecting our rights.

The legal basis for processing is the performance of a contract pursuant to Article 6(1)(b) GDPR.

We retain this information for as long as necessary to fulfil your order and generally for a further three years. Where the information is no longer required to comply with a legal obligation or protect our rights, we will delete it sooner.

Please do not send us information or photographs containing sensitive personal data that is not necessary for the production of your product.

RETURNS, EXCHANGES, COMPLAINTS AND WITHDRAWAL FROM THE CONTRACT

When handling a return, exchange, complaint or withdrawal from the contract, we may process in particular:

  • your name and contact details,

  • order number,

  • information about the returned or claimed product,

  • the reason for a complaint,

  • photographs of the product,

  • information required to process a refund,

  • the content of related communications,

  • the date and time of an electronically submitted withdrawal.

We process this information in order to handle your request, fulfil our contractual and legal obligations and protect our rights.

The legal basis for processing is the performance of a contract pursuant to Article 6(1)(b) GDPR, compliance with legal obligations pursuant to Article 6(1)(c) GDPR and, where applicable, our legitimate interest pursuant to Article 6(1)(f) GDPR.

We retain the relevant documentation for the duration of the matter concerned and generally for a further three years. If a dispute arises or applicable legislation requires a longer retention period, we may retain the information for the necessary additional period.

NEWSLETTERS AND MARKETING COMMUNICATIONS

If you subscribe to our newsletter, we process your e-mail address on the basis of your consent pursuant to Article 6(1)(a) GDPR.

If you have previously purchased from us, we may, where permitted by applicable law, send you information about our own similar products and services. You may object to receiving such communications at any time and free of charge.

Every marketing communication includes an easy way to unsubscribe. You may also unsubscribe by contacting us at info@divinite.cz.

We process data used for newsletters until you withdraw your consent or object to receiving such communications, but generally for no longer than three years from your most recent purchase or active interaction, unless your consent is renewed.

Withdrawal of consent does not affect the lawfulness of processing carried out before the consent was withdrawn.

WEBSITE VISITS, ANALYTICS AND ADVERTISING

When you visit our website, we may process technical information including:

  • your IP address,

  • device, operating system and browser type,

  • approximate location derived from your IP address,

  • pages visited and actions taken,

  • identifiers from cookies and similar technologies,

  • information about how you reached our website,

  • information about adding products to your cart, beginning the checkout process or completing a purchase.

We process essential technical data for the purpose of ensuring the security and proper functioning of our website.

Analytics and advertising technologies are used only on the basis of your prior consent provided through our cookie banner. You may change or withdraw your consent at any time through the “Cookie Settings” link on our website.

Subject to your consent, we may use services including Google Analytics, Google Ads and Meta advertising tools to measure website traffic and evaluate advertising performance.

RECIPIENTS OF PERSONAL DATA

We do not disclose personal data to other parties without a valid reason. However, where necessary, personal data may be accessed in particular by:

  • Wix.com Ltd. and its affiliated companies – operation and technical provision of our online store,

  • Comgate a.s. – payment processing through the payment gateway,

  • banks and payment service providers – processing and settlement of payments,

  • carriers selected for a particular order and their international partners – delivery of orders,

  • providers of e-mail, IT, accounting, legal and other professional services,

  • Google Ireland Limited and its affiliated companies – analytics and advertising, where you have provided consent,

  • Meta Platforms Ireland Limited and its affiliated companies – advertising measurement and personalisation, where you have provided consent,

  • public authorities where disclosure is required by applicable law.

Depending on the nature of the services provided, individual service providers may act either as our data processors or as independent data controllers.
